Judiciary through established procedural orders and enforcement of the rule of law, take it or leave it, by all means, consideration and standard is assuredly the last hope of not only the common man but just anybody questing for justice. Only in beast and crude animal kingdoms are expectedly to be found missing anything nearing establishment of the rule of law and enforcements. Even in the Kingdom of Heavens where the Almighty God reigns are to be found established rule of laws, orders and enforcements not only for the hosts of heaven to obey but after all passed down to we humans to obey, observe and enforced.
The charade of reckless and irresponsible applications brought before the Supreme Court of very recent by power seeking at all cost political litigants was not only embarrassing to human good reasoning and mentality but was an invitation calling on the sacred Supreme Court institution to commit Hara- Kiri. The most painful aspect of the odiferous saga was those that involved two of notable best and astute legal brains of Yoruba beauty Chief Afe Babalola SAN and Chief Wole Olanipekun SAN. The duo need not have allowed themselves to be brought down in value, tutored by that beauty and brain Hon Justice Amina Augie that “once this court has finally determined an issue it becomes functus – officio. It is final for ever, only legislation can alter it, is final for all ages”
Hon Justice Amina Augie reasonably added a classical summary that if the applications were not dismissed “ every disaffected litigant will bring appeals ad- infinitum” One can only head bow down to Justice Augie drawn conclusion that there must be an end to litigation to ensure certainty in the law. There must be finality to the decision of the court” With the highly embarrassing influx of Judgment Review Applications that suddenly found themselves coming to taunt the Supreme Court , one with hope in the sanctity of the judiciary found hope and solace in the wise decision not allowing the nation’s highest citadel of justice cowed and destroyed.
